California Update o CA AB 1305 / AB 2331 ▪ Unclear if REC purchases trigger disclosure filings ▪ CARB unlikely to address until Q1/Q2 2025 ▪ Original statute does not specify date of first filing • Statute becomes effective January 1, 2025 (that's different) • Author of the bill released letter conceding that the law does not specify a first filing deadline, but that he intended 1/1/2025 ▪ AB 2331: exclude RECs and set 7/1/2025 filing deadline • REC exclusion clause struck from the bill in Senate vote • Did not get final vote in Assembly before session ended o VREP ▪ We spoke with CARB and they are considering adding more free allowances in the Spring © 2024 Center for Resource Solutions

Standard Updates: Texas • Change to TX RPS: o Texas’ PUC adopted a new 16 TAC §25.173, relating to Goal for Renewable Energy. ▪ CP will only be issued for solar 1/1/2024-12/31/2024 ▪ No CPs will be issued starting 1/1/2025T ▪ https://legiscan.com/TX/text/HB1500/id/2820169 • Resulting Green-e Energy Policy o RECs generated during a period that CPs were issued for the corresponding generation, those RECs and an equal amount of CPs from the same facility are both retired. o This policy applies to: ▪ Generating facilities in Texas that use a renewable resource (as defined in this document) other than wind energy.1 • For solar facilities, generation takes place prior to January 1, 2025, or • For non-solar, non-wind facilities, generation takes place prior to January 1, 2024 © 2024 Center for Resource Solutions
