    the WFD Article 4.7 Article 4.7 sets out circumstances in which failure to achieve certain Water Framework Directive objectives is permitted. The article can be used in the following circumstances: 1) When failure to achieve good groundwater status, good ecological status or, where relevant, good ecological potential or to prevent deterioration in the status of a body of surface water or groundwater is the result of new modifications to the physical characteristics of a surface water body or alterations to the level of bodies of groundwater, or 2) When failure to prevent deterioration from high status to good status of a body of surface water is the result of new sustainable human development activities. EXEMPTIONS TO THE ENVIRONMENTAL OBJECTIVES UNDER THE WATER FRAMEWORK DIRECTIVE ALLOWED FOR NEW MODIFICATIONS OR NEW SUSTAINABLE HUMAN DEVELOPMENT ACTIVITIES (WFD ARTICLE 4.7) Common Implementation Strategy for the Water Framework Directive Exemptions to the Environmental Objectives under the Water Framework Directive allowed for new modifications or new sustainable human development activities (WFD Article 4.7) Policy Paper

    the SEPA view The Water Environment (Controlled Activities) (Scotland) Regulations 2005 (CAR) SEPA objects to this application as the development currently proposed will result in deterioration in the ecological status of the River, causing it to fall from high to good status. As such the proposals are contrary to the environmental objectives outlined in Article 4 (1) of the Water Framework Directive (WFD). SEPA notes that a CAR application has been submitted however it is still at an early stage of assessment and will be subject to third party consultation, including with other water users. SEPA considers, on the basis of information supplied thus far, that the activity cannot be modified/mitigated sufficiently to allow the objectives to be met. SEPA must therefore assess the proposal under Article 4 (7) of the WFD which allows a derogation from the objectives of the WFD to be applied in circumstances where the proposals succeed in satisfying all of the following criteria: a) all practicable steps are taken to mitigate the adverse impact on the status of the body of water; b) the reasons for those modifications or alterations are of overriding public interest and/or the benefits to the environment and to society of achieving the objectives set out in paragraph 1 are outweighed by the benefits of the new modifications or alterations to human health, to the maintenance of human safety or to sustainable development, and c) the beneficial objectives served by those modifications or alterations of the water body cannot for reasons of technical feasibility or disproportionate cost be achieved by other means, which are a significantly better environmental option. SEPA will be prepared to remove its objection to this application if the proposals can be shown to meet the above criteria.
