    usually it lists a date when the lease will end, at which point you might have the option to renew it. This is important because a landlord is never required to renew your lease, so when your lease ends, your landlord may decide he does not want to rent to you anymore. But the flip side is that your landlord cannot ask you to leave before the end of your lease (unless you break one of the terms of the lease, which will be discussed in the next subsection). However, it is not uncommon for a person to live in an apartment under a lease that doesn’t end on a specific day. A person can get into this situation in several di erent ways. When this happens, Texas law says you are a “month-to-month” tenant. That means your landlord can end the lease at any time, but he must give you at least 30 days notice. Second, what are the terms of your lease agreement? Most written leases include many terms and conditions. For instance, the lease might say you can’t smoke in the apartment; or you can’t keep pets; or you can’t allow visitors to stay for more than a few days. A lease is a contract, and it’s only good for as long as both sides follow it. If you break one of the terms in the lease, a landlord can ask a court to evict you. You have rights when someone wants to remove you from a residence, but they are di erent if you’re a tenant than if you’re a guest. Tenants have more rights – they can’t be forced to leave their home unless the property owner goes to court to evict them. If you have a written lease, then it is obvious that you’re a tenant. But you don’t need to have a written lease to be a tenant (and have the protections the law gives to a tenant). The law defines a lease as any agreement (when written or spoke) regarding the “use and occupancy” of a dwelling. So if you have an agreement or understanding with a property owner than you can stay indefinitely in a residence, they cannot then remove you without using the eviction process.
